Walther <br />Executive Director <br />PO BoX 459 Michael 8. long <br />Florence, CO 81226 Division Director <br />Re: Borehole Reclamation at the Kerr Mine <br />Permit Number C-80-006 <br />Dear Mr. Patterson, <br />In conjunction with the recent meeting with Kerr Coal Company (KCC), BLM, OSM and <br />Montgomery Watson Hazza, the Division has completed a review of the boreholes that <br />remain at the mine site and the exploration lease. The following aze comments and <br />findings based on the review. <br />KCC has identified the following wells as possible water wells - 79-60, 80-2, 80-11 and <br />BLM-20. Since these wells aze all on BLM property, retention of any or. all of these <br />wells is up to the discretion of the BLM. If BLM decides to keep any or all of the wells <br />open for use as water wells, they must be permitted by the State Engineer's Office. If [he <br />State Engineer's Office does not permit the wells, they must be sealed in accordance with <br />stipulation j of Coal Exploration License C-28056 dated 1 November 1979. Any <br />altemative sealing method must be approved by BLM and the Division. <br />Wells 79-1, 79-2, 79-3, 79-61, AO-2A and SP-Ol may remain open, as they aze part of <br />the currently approved hydrological monitoring plan. Once the Division deems [hat these <br />wells are no longer needed for hydrological monitoring, they must be sealed in <br />accordance with stipulation j of Coal Exploration License C-28056 dated 1 November <br />1979. Any alternative sealing method must be approved by BLM and the Division. <br />All remaining wells must be sealed in accordance with stipulation j of Coal Exploration <br />License C-28056 dated 1 November 1979. It is the understanding of the Division that BLM <br />may be willing to allow an altemate sealing method on a case-by-case basis, depending <br />on a field study of each well. Any altemate sealing method must be approved by the <br />Division as prescribed in Rule 4.07. <br />
