999 <br />E~ ^~ECi4 Seneca Coal Com„an <br />S Coal Company P Y <br />Auqust 31, 1995 <br />Ms. Susan Burgmaier /~ <br />Division of Minerals and Geology ~CF/~/~~ <br />1313 Sherman Street, Room 215 s£/~ OS <br />Denver, CO 80203-2273 <br />Divisio 995 <br />RE: ~pulationn5mtotPermitcNO nC-80e005a II Mine n~rM~neiaiS.4Ueu~~y~ <br />Dear Ms. Burgmaier: <br />Stipulation 5 to Permit No. C-80-005 is as follows: <br />"The embankment must be inspected annually, or within 10 days <br />following any storm whose backwater elevation exceeds the elevation <br />of 6941.1 feet above sea level (10-year, 24-hour maximum storm <br />event's projected backwater elevation), by a qualified Geotechnical <br />Engineer or Engineering Geologist. A letter of certification <br />containing the results of the inspection must be submitted to the <br />Division within two weeks following the inspection." <br />In accordance with this stipulation, i, Michael G. Altavilla, <br />Colorado P.E. 28455, inspected the subject embankment on June 28, <br />1995 and do herewith submit my report of findings: <br />I. Chronology <br />A. July 14, 1981: F.M. Fox and Associates submitted a report <br />on their geotechnical slope stability investigation of <br />the embankment. The report concluded that the embankment <br />was stable with a minimum static safety factor of 1.52. <br />The report also recommended revegetation and inspections. <br />B. September 23, 1981: Colorado Mining Permit No. C-80-005 <br />became effective. <br />C. Fall 1981: The embankment was hand seeded in compliance <br />with Stipulation 16 of Permit No. C-80-005. <br />D. June 15, 1982: The annual embankment inspection was <br />conducted. weather conditions were favorable, skies <br />partly cloudy, temperature about 65" F. A light rain had <br />fallen on the evening of June 14th. <br />E.' July 18, 1983: The annual embankment inspection was <br />conducted. weather conditions were favorable, skies <br />partly cloudy, temperature about 84" F. The mine area was <br />dry and mine personnel reported that no measurable <br />Seneca Coal Company • P.O.
