The inspection was performed by <br />myself, John Effinger III, a registered professional engineer in the State of Colorado since <br />December, 1975. I have experience and knowledge in the design and construction of <br />dams, drainage control, hydrology and structures; including experience in portions of the <br />permitting process of coal mine facilities and permit compliance. <br />The purpose of this inspection and certification was to check for structural <br />weakness, erosion, other hazardous conditions and identify required maintenance and to <br />satisfy the requirements of Rule 4.05.9 (l3) of the Colorado Mined Land Reclamation <br />Board for Coal Mining. In addition to the on site inspection referenced above, actions <br />taken in preparing this certification included review and discussion of applicable mine <br />maps and state regulations with yourself. <br />Said inspection was performed on a warm (80°), mostly sunny Tuesday morning <br />by myself. Most of the site was traversed with a two wheel drive vehicle with frequent <br />stops and hiking trips azound the pond. The following is a statement of my professional <br />observations and conclusions from this inspection: <br />The entire impoundment was examined for structural weakness, erosion, tears to <br />hypalon lining and other hazardous conditions; none were found. <br />Existing water level was about 2 feet below maximum level line. <br />Hypalon lining in good condition. Several small teazs in the hypalon lining were <br />observed along the north and west sides, well above high water level, and two <br />tears along the south face. <br />
