<br />No sign of erosion damage. <br />Aquatic plant growth in the middle of the pond was observed. <br />Small amount of sedimentation at junction of inlet channels and bottom of pond. <br />Recent efforts to remove a portion of these sediments have left several piles. When <br />conditions permit, remaining sediments should be removed. <br />Comments and/or recommendations for this quarterly inspection report include <br />monitor side slopes for erosion damage and perform pond cleaning & maintenance as <br />required. <br />To the best of my knowledge, based upon my professional expertise, the <br />Sedimentation Pond No. 4 at the SouthSeld Mine is being maintained in conformance with <br />the prudent state-of--the-art of earthen embankment construction. <br />I hereby certify, based upon my Seld observations and professional investigations, <br />as detailed here above, that the Sedimentation Pond No. 4 at Energy Fuels Coal, <br />Incorporated's SouthSeld Mine, located in Fremont County, Colorado, is being <br />maintained in compliance with the requirements and regulations of the Colorado Mined <br />Land Reclamation Division. <br />By: <br />
