Colorado 81230 <br />July 9, 1997 <br />Oxbow Carbon and Minerals, Inc <br />Attn: Thomas Anderson <br />PO Box 535 <br />Somerset, CO 81434 <br />Dear Mr. Anderson: <br />The purpose of this correspondence is to confirm that Gunnison County has reviewed <br />the Oxbow request, per your letter dated July 9, 1996, to drill an emergency borehole <br />for methane mitigation. This request was forwarded to County Manager John <br />DeVore and Planning Director Joanne Williams for consideration. <br />Gunnison County will allow for the immediate drilling of the emergenry borehole and <br />placement of a vacuum pump to be installed on the collar at the site; this allowance is <br />being established because of the emergency situation, but it does not constitute a land <br />use change that will run with the real property. If this borehole is going to become a <br />permanent facility associated with the mine operation, approved policy mitigation <br />measures may be required.
