Berry October 17, 1996 <br />Re: Somerset Domestic Water Supply Drop Structure <br />During June 1996, the Corps of Engineers was contacted about <br />modification to the Permit Number GP37-035 issued December 22, <br />1987. Mr. Randy Snyder with the Corps of Engineers requested an <br />application for a new permit with a design for a vortex or W rock <br />weir drop structure. <br />Following several attempts to contract the design with hydrologists <br />recommended by Mr. Snyder, a design was developed by Mr. Robert J. <br />O'Brien, and an application was submitted to the Corps of Engineers <br />on August 8, 1996, copy enclosed. The design requires three drop <br />structures, constructed of large diameter rock, to be built across <br />both channels of the river. <br />Sources for the required large diameter, dense, angular rock close <br />to the river were considered. The closest, most suitable material <br />was determined to be on the south side of the river within the <br />Mountain Coal Company, West Elk Mine rock storage area. A letter <br />requesting assistance from the West Elk Mine was sent on August 12, <br />1996, copy enclosed. <br />West Elk Mine responded on September 20, 1996, and a site visit was <br />made on September 27, 1996. Further clarification to the proposed <br />project plan was sent to the West Elk Mine on October 2, 1996. On <br />October 4, Oxbow Carbon and Minerals, Inc., Sanborn Creek Mine <br />received Permit Number 199675386 from the Corps of Engineers for <br />construction of the drop structures, copy enclosed. <br />We have prepared a drawing, outlining the proposed project, to show <br />construction of a temporary road from Oxbow Carbon and Minerals, <br />Inc. property on the north side of the river to the rock storage <br />area on Mountain Coal Company property on the south side of the <br />river. One question you raised during your site inspection in <br />September was the location of the Permit Area Boundary. <br />The Permit Boundary shown on the project drawing is the West Elk <br />Mine Permit Boundary, as supplied to us. The Sanborn Creek Mine <br />Permit Boundary is as shown on Drawing Number C8-1120, Page 2.04-4, <br />of the current permit document, and includes the area of the <br />previous drop structures. The legal description of the permit area <br />submitted with Permit Revision Number 3, pending approval, for <br />Section 9, Township 13 South, Range 90 West, is All North of River. <br />XBOW 2 <br />
