The <br />survey was rerun to simplify the legal to one closed area. The acreage change result is a <br />~`~ decrease from 8.8 to 8.2 which has been changed on appropriate maps but does not change the <br />application acreage of 9 acres. The mining leases have been corrected to legal descriptions as <br />found in this submittal. The reclamation plan map has been changed to correspond to the legal. <br />2) The above changes will not affect this exhibit. ~v; ~i 6 cz Uyt-5 flzw 52D <br />3) On page 3 of the site description the thickness of the waste pile was noted at 50'. Exposed waste <br />rock faces along the Canterbury/Graley property boundary also measure about 50' in height. <br />It is assumed that a similar thickness will be encountered throughout mining area. <br />4) The statement regarding culverts was made to address a theoretical condition that may or may <br />not be encountered while removing the waste piles. There is no way to know the exact ground <br />condition prior to the dump material being placed at its present location. It appears that the <br />working face will be dry and therefore no culverts aze planned as a condition of mine plan. In <br />L~/' the event that springs or seeps aze intercepted while mining, an appropriate water quality control <br />~~.~ry plan will be implemented and the Division will be notified of such development. The Corp of <br />N, "P Engineers Pueblo office personnel has related that the Corp no longer has jurisdiction of this <br />`~/ type of water occurrence within a mining area. Most certainly, this type of water occurrence <br />would not be considered working within the stream channel of Howard Creek. <br />5) It is expected that process operations will create a small to negligible amount of dust that will <br />be controlled if necessary with water trucked to the site via contractor or county water truck. <br />Water needs are not expected to exceed 4000 gallons per day. <br />
