Hatcher <br />8/13/2007 <br />Page3 <br />The steady state lagged mining depletions are shown in the attached Table 1. <br />Replacements <br />The proposed sources of replacement water are 25 shares of Fulton Ditch and fully <br />consumable water leased from the Saint Vrain Left Hand Water Conservancy District and the <br />City of Aurora. The Fulton Ditch water will be recharged into Zigan Reservoir which is a <br />reclaimed gravel pit located in Section 35, Township 1 South, Range 67 West, 6"' P.M. <br />The historic use of the 25 Fulton ditch shares yields 43.89 acre-feet of water during Aprif <br />through October while generating 5.25 acre-feet of return flow obligation during November <br />through March. This quantification is based on the technique used in the March 24, 1999 <br />approval for the Fulton Lakes Pit, where the historic consumptive use values were determined <br />using an analysis decreed in case number 82CW393. In this approach, headgate diversions <br />were based on average monthly values for the period of 1976-1988 and a 10% conveyance loss <br />was assumed as well as a farm efficiency of 50°~. The return flow obligations, which were not <br />addressed in the above decree, were calculated for this plan based on the assumption that all <br />water diverted but not used by the crops is returned to the stream system through deep <br />percolation. The historical consumptive use and net consumptive use credit realized at the river <br />from recharge of the Fulton Ditch shares is shown on attached Table no. 2. <br />The plan will also account for the impacts and credits from the dewatering at the <br />Stagecoach pit. The plan estimates that dewatering will occur for 8 hours per day, 365 days per <br />year at a rate of 1,000 gpm. See attached Appendix D for the estimated credit and depletions <br />from dewatering. <br />The Applicant will lease 28.2 acre-feet of fully consumable replacement water from the <br />Saint Vrain Left Hand Water Conservancy District ("SVLH") for November 2006 through March <br />2007. The point of replacement for the SVLH water will be the convergence of Saint Vrain <br />Creek and the South Platte River. <br />The Applicant will lease about 180 acre-feet of fully consumable replacement water from <br />the City of Aurora (per phone call on July 19, 2007 between Ms. Michelle L. Hatcher and Bill <br />McIntyre) for the period of November 2006 through October 2007 (includes 3.7 acre-feet for <br />transit losses). The City of Aurora water will be released from the Metro Waste Water <br />Treatment Plant and all replacements will account for transit losses. <br />The total lagged mining depletions and replacements are shown on attached Table no. 3, <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shalt be valid for the period of November 1, 2006 through October <br />31, 2007, unless othervvise revoked, modified, or superseded by decree. If <br />this plan will not be made absolute by a water court action by the plan's <br />expiration date, a renewal request must be submitted to this office with the <br />statutory fee (currently $257 per site) by August 31, 2007. <br />2. The total area of pond surface exposed after December 31, 1980 for each of <br />the unlined pits shall not exceed those values listed in Table A of this <br />approval. Should the total surface area exposed exceed those amounts, an <br />amendment will need to be filed with this office. The total lagged depletions <br />resulting from operation of the pits shall not exceed those amounts specified <br />in attached Table 3.
