Article V is hereby amended to read as follows: <br />ARTICLE V <br />USE OF PROPERTY <br />The leased premises shall be used solely <br />for the purpose of constructing, operating, main- <br />taining and using a roadway for the movement of <br />persons, vehicles and property of all kinds and <br />character~on, over and across said roadway in <br />connection with the construction and operation of <br />a coal loadout facility which the Lessee intends to <br />construct on the S1/25W1/4 of Section 14 and the <br />E1/25E1/4 of Section 15, all in Township 6 North, <br />Range 88 West of the 6th P.M., Routt County, <br />Colorado md_in connection with coal haulage by or <br />fOt Peabody. Coal Company or Seneca Coals, Ltd. <br />Lessee may permit others, including its employees, <br />agents, contractors, licensees and assigns, to use <br />the leased premises for such purposes. in the <br />event that the Lessee, its successors or assigns, <br />cease to use said leased premises for such purposes <br />and remove all property and equipment from the <br />leased premises, Lhe lease shall terminate. <br />2.
