i • <br /> Mined Land Reclamation Board Page 2 <br /> August 26, 1980 <br /> by the Water Court will be necessary prior to issuance of <br /> well permits due to the over appropriated condition of St. Vrain <br /> Creek. <br /> 2. The applicant mentions in his report that pumping from the <br /> gravel pits during Phase II has caused a lowering of the water <br /> table in those adjoining lands to the east, and that when he <br /> dewaters the gravel pits , a part of the water being pumped for <br /> dewatering is being diverted to the adjoining pasture land as <br /> needed in accordance with a verbal agreement. We must have <br /> more details of this procedure and agreement to determine the <br /> impact upon vested water rights . <br /> 3 . We do not believe that the statement on page 4 of the report, <br /> that no water is consumed as a result of the mining operation <br /> and that the amount of water flowing through the lake will be <br /> equivalent to the amount flowing into the lake , has been sup- <br /> ported with sufficient evidence. These lakes will expose the <br /> existing ground water table and will result in evaporation losses <br /> from the lake's surfaces which obviously will result in a loss of <br /> water in the ground water supply system. If the applicant feels <br /> that the loss of water due to evaporation from the pond will <br /> equal the losses from historic consumptive use , he must provide <br /> adequate information to support his position. <br /> 4. Without well permits and a plan for augmentation to minimize <br /> the impact upon the hydrologic balance, the applicant is not in <br /> compliance with CRS 1973 , 34-32-115(4)(c) and (g) as well as <br /> CRS 1973 , 37-90-137. <br /> 4/_ v <br /> Hal D.
