SIMPSON, CHIEF, WATER MANAGEMENT BRANCH SUBJECT: VARRA COMPANIES , INC. , #74-52, WELD COUNTY, APPLICATION FOR MINING AND RECLAMATION PERMIT As requested by your staff, we have reviewed the above referenced application for a gravel pit 6 miles north of Firestone along St. Vrain Creek. We cannot recommend approval of the application until the applicant has responded to the following statements and requirements: 1 . The Land Stabilization Agreement signed in 1974 mentions that the project area will be reclaimed and used for picnic and camping purposes. The State Engineer has determined that the recreational use of ground water in a gravel pit would be a beneficial use of water and, therefore , a well permit will be required for each lake before the lakes can be developed. In addition, if the applicant plans to use water from the lakes for dust control, which is considered to be an industrial use of the water, the applicant needs to have a well permit issued for industrial use. The well currently located on the land has been decreed for 2. 0 cubic feet per second and restricted to irrigation use on 72 acres of land in the NWI/4 of Section 31, Township 3 North, Range 67 West. The decree, Case No. W-7551, states that the owner of the well cannot increase or enlarge the irrigated lands under this water right or change the type of use of the water. Therefore, the applicant may not have a water right which could be used in a plan for augmentation. A plan for augmentation approved
