SIMPSON, CHIEF, WATER MANAGEMENT BRANCH <br /> SUBJECT: VARRA COMPANIES , INC. , #74-52, WELD COUNTY, APPLICATION <br /> FOR MINING AND RECLAMATION PERMIT <br /> As requested by your staff, we have reviewed the above referenced application <br /> for a gravel pit 6 miles north of Firestone along St. Vrain Creek. We cannot <br /> recommend approval of the application until the applicant has responded to the <br /> following statements and requirements: <br /> 1 . The Land Stabilization Agreement signed in 1974 mentions <br /> that the project area will be reclaimed and used for picnic <br /> and camping purposes. The State Engineer has determined <br /> that the recreational use of ground water in a gravel pit <br /> would be a beneficial use of water and, therefore , a well <br /> permit will be required for each lake before the lakes can <br /> be developed. In addition, if the applicant plans to use <br /> water from the lakes for dust control, which is considered <br /> to be an industrial use of the water, the applicant needs to <br /> have a well permit issued for industrial use. The well currently <br /> located on the land has been decreed for 2. 0 cubic feet per <br /> second and restricted to irrigation use on 72 acres of land in <br /> the NWI/4 of Section 31, Township 3 North, Range 67 West. <br /> The decree, Case No. W-7551, states that the owner of the <br /> well cannot increase or enlarge the irrigated lands under this <br /> water right or change the type of use of the water. Therefore, <br /> the applicant may not have a water right which could be used <br /> in a plan for augmentation. A plan for augmentation approved <br />
