These shares are currently used to offset depletions at the Howe <br />Pit (M78-052) located immediately south of ttie Mann Lake Pit. The credits claimed in this <br />proposal are the excess river credits that are returned to the stream between May and <br />September. <br />The third source of replacement for this substitute water supply plan is a lease agreement <br />with the City of Greeley for 21.4 acre-feet of WWTP effluent. A copy of the current lease <br />agreement with the city provides 8.7 acre-feet from the period September through December <br />2001. Conditional approval of this plan through December 2002 is contingent upon submittal of a <br />new lease agreement with the city. <br />The final reclamation plan for Mann Lake calls for 3 lined ponds. To date, one of these <br />ponds, located in the northeastern part of the site has been lined. The remaining two ponds have <br />only been partia4ly lined. This site is currently being dewatered, however, if the dewatering of the <br />site is discontinued the two unlined ponds would fill creating additional depletions to the stream <br />system due to increased evaporation. To assure that this depletion to the river does not occur, <br />Lafarge has obtained a bond for 5730,400 through DMG to complete the lining of the remaining <br />two ponds at this site. Therefore, if dewatering is discontinued this bond can finance the <br />completion of the liner at the lakes, thus preventing depletions to the stream system. <br />A monthly breakdown of depletions and replacements is shown in the attached Table No. <br />2 that was submitted with your report. <br />As required by Section 8 of Senate Bill 89-120, this substitute water supply plan has been <br />provided to an outside consultant for review. The consultant has recommended approval of the <br />plan by way of a draft of this letter. Based upon statutory requirements and the recommendations <br />of the consultant, I hereby approve the proposed substitute water supply plan in accordance with <br />Section §37-80-120, C.R.S., subject to the following conditions' <br />A new permit must be obtained for the current use and exposed pond surface area of <br />the gravel pi[. The pending permit application (Receipt Number 475430) will be <br />evacuated pursuant to this plan. You have noted that as rnany as 5 wells may be <br />affected by this gravy=_I well permit application. These inclutle one unregistered well and <br />four permitted wells (Permit Nos. 96403VE, 13868, 13869, and 124641 A). The owners <br />of these wells were notified pursuant to C.R.S. 37-90-137(2)(b}(II)(A), and no responses <br />were received. <br />2. The per year losses associated with this mining operation rrwst not exceed a total of <br />100.6 acre-feet for the duration of this permit approval as outlined in the attached table. <br />These losses include 71.1 acre-feet of evaporation from ttie existing and proposed <br />exposure of groundv+ater, 3.0 acre-feet of water used for dust suppression and 26.5 <br />acre-feet of water lost in 900,000 tons of aggregate mined. Should the annual <br />depletions to the South Platte IZver exceed 100.6 acre-feet prior to the expiration date <br />of this plan, an ameroiment will need to be f led with this office. <br />
