Part I <br />Page lh of 19 <br />Permit No. CO-0000132 <br />B. MONITORING REQUIREMENTS <br />7. Phase I THE <br />The Phase I THE performed by the permittee shall be in general <br />accordance with Methods for Aquatic Toxicity Identification <br />Evaluations, Phase I, Toxicity Characteri2ation Procedures (September, <br />pu s y , or n actor ante w t proc ures approved by <br />the Division. If only one species demonstrated toxicity during <br />accelerated testing, then that species alone may be used in the Phase <br />I TRE. The petv~ittee has 45 days from the submission of the final <br />report on the preliminary toxicity investigation to complete the Phase <br />I THE and submit a report to the Division on the results of the study. <br />If the Phase I THE identifies a probable toxicant and/or a probable <br />source of tonicity, the permittee shall submit written notification to <br />that effect to the Division as part of the report. Within 30 days of <br />completing the Phase I TRE, the permittee shall submit for the <br />Division's approval a control program to control WET, and shall <br />proceed to implement such plan within 7 days following approval by the <br />Division. <br />If the Phase I T4E fails to identify a probable toxicant and/or a <br />probable source of toxicity, the permittee shall notify the Division <br />of tts findings. The Division will determine whether a Phase II THE <br />is applicable. <br />If toxicity disappears during the Phase I TRE, the permittee shall. <br />submit written notification to that effect to the Division. The <br />Division may require the permittee to conduct accelerated testing to <br />demonstrate the continued absence of toxicity. If no acute toxicity <br />is found to eaist, the toxicity incident is closed. <br />8. Phase II THE <br />If a Phase II THE Ss required, then the following conditions apply: <br />A plan fora Phase II THE shall be submitted to the Division by the <br />pexmittee within 60 days of notification from the Division that a <br />Phase II THE will be required. The Phase II TRE, as submitted to or <br />revised by the Division, shall be incorporated into the permit. <br />The Phase II THE plan shall include the scope, methods, procedures, <br />reporting requirements, and schedules. A Phase II THE may follow <br />either of two directions, as appropriate: toxicant treatability <br />studies, or source identification and control studies: Toxicant <br />treatability studies are designed to assess the feasibility of <br />eliminating WET via addition or modification of treatment p m cesses at <br />the wastewater treatment facility. <br />Source identification and control efforts are designed to identify <br />toxicants, identify the sources of toxicants, and control whole <br />effluent toxicity by eliminating the introduction of toxicants into <br />the wastewater treatment facility. The Phase II THE permit conditions <br />may be amended, if so requested and justified by the pe nnittee. <br />
