~, <br />J <br />SETTING: <br /> <br />As shown under Exhibit A -Theatre [English spelling] of Operat! <br />Companies, Inc., existing extraction activities are presently contained <br />31, Township 3 North, Range 68 West, 6th P.M., Weld County, Colore <br />are three separate permits involved, each in various stages of activity. <br />Varra <br />Section <br />There <br />Varra Companies, Inc., has one of the earliest, still active, mi ing and <br />reclamation permits on file with the Colorado Division of Minerals and Geology. <br />identified as permit M74.052, or Pit 1 [384.0 combined acres], extraction activities <br />have ceased and reclamation is completed or undenr/ay for the Origi al [149.0 <br />acres] and first Amended areas [155 acres]. These operations are pending <br />approval of a Temporary Substitute Supply Plan, and approval of th t plan is <br />anticipated. <br />The second Amended area of Pit 1 [80.0 acres] is already approve by the <br />DMG, and operations are expected to commence sometime in the lat r half of <br />this year, pending approval of this Letter of lntent, and subsequent t fulfilling <br />any remaining issues pertaining to the Weld County Special Use ermitting <br />process. This operation would be the beneficiary of the propose Master <br />Temporary Substitute Supply Plan. <br />DakoHos Pit - M84.036 [120.0 acres], is fully developed for extraction. Re lamation <br />is occurring only in the form of active backfilling of an existing po d. The <br />operation is presently under review for a Temporary Substitute Supply Ian, and <br />approval of that plan is anticipated. <br />Von Ohlen Pit - iH89.128 [71.5 acres], is presently operated by Siegrist Co struction <br />Company. The land has been acquired by Varra Companies, and the Aeration <br />will be assumed from the Colorado Division of Minerals and Geology -Office of <br />Mined Land Reclamation [DMG], soon. This operation is nearing com letion of <br />extraction activities. Reclamation is concurrent with extraction and will r suit in a <br />lined reservoir, scheduled for completion this year. <br />There are no other operations planned in Section 31 at this time, but o erations <br />are anticipated at other locations along St. Vrain Creek soon [Specifica ly Plt 112 <br />(aka, Siegrlst Plt) - iN84.079]. These operations comprise the beneficiari of this <br />Letter of Intent and the proposed Master Temporary Substitute Supply P an. <br /> <br />Exhibit B, shows the Theatre of Operations relative to the NOAA isobar of ~0 inches <br />annual free-orator surface evaporation.
