<br />J' <br />Mr. Gary Curtiss <br />Division of Minerals and Geology <br />December 29, 1997 <br />Page 2 <br />All on-site structures (asphalt plant, office, wash plant, stockpiles, etc.) except the shop <br />and concrete plant, are temporary and movable (see Exhibit C). The approximate size of <br />the temporary structures are: <br />Asphalt plant - 20' x 80' <br />Office - 14' x 60' <br />Wash Plant - 20' x 20' <br />Crusher - 12' x 20' <br />Screens - 12' x 40' <br />The footprints of the concrete pla,u and shop are 20' x 50' and 40' x 50', respectively. <br />Both structures are located in the area to be mined last. When mining occurs in this area, <br />both strictures will be dismantled and the gravel removed and sold as a raw product. <br />4.) The post-mining use for Phase 1 is a private lake and water reservoirs for Phases 2 and 3, <br />not pastureland (see Exhibit E). The operator is committed to stockpile and replace a <br />miuimum of six to ten inches of topsoil. <br />5.) The inert fill imported and used as backfill will adhere to Division of Mineral and <br />Geology's rules 1. ] (20) and 3.1.5 (9) (a) - (e). <br />6.) Concerns outlined in the letters received by Bataa Oil, Inc. and the Division of Water <br />Resources, Office of the State Engineer are addressed as follows: <br />Bataa Oil, Inc. <br />Tuttle Applegate, Inc. and the operator have been working with Bataa to address their <br />concerns. The two additional wells proposed have been accommodated and are <br />illustrated on the mining and reclamation plans (see Exhibits C and F). To maintain <br />operation on these wells, a 75' radii (minimum) around the well heads and 100' x 150' <br />tank battery areas have been provided and to access the well (Dersham #43-36) on the <br />H.I.B.E. property, a 34' wide strip of land along the east boundary of Phase 2 is proposed. <br />Within this strip of land, the service road and flowlines from the well to the tank battery <br />will be located. The access road to the other well (Eiberger #12-31) has no bearing on <br />this project, therefore, the location of this road can be determined by the property owner <br />and Bataa. <br />Water Resources, Office of the State Engineer <br />Mining will commence in Phase ] of Lot C where a current temporary substitute supply <br />plan and well permit exist. A substitute supply plan is currently being developed for <br />Phases 2 and 3 and will be submitted to your office on Wednesday December 31, 1997. <br />1!
