pads may also be approved for constmction within the Water Influence Zone (WIZ), when the Paonia District <br />Ranger decides that effects can be mitigated and no better location for the proposed facility exists. The other roads <br />and drill pads that may be constmcted within or adjacent to the WIZ include, but are not limited to: <br />West Bench Road <br />Saddle Spur <br />17S-06 Spur <br />RAV-1 Spur <br />17-07 drill pad <br />175-06 drill pad <br />17S-08 drill pad <br />22-01 drill pad <br />22-08 drill pad <br />23-04 drill pad <br />24-03A drill pad <br />24-OS drill pad <br />24-06/24-07 drill pad <br />The maximum amount of land this exception would apply to if all of the above mentioned facilities were constmcted <br />in the WIZ would be 9.2 acres. The mitigation measures described in the Condifions of Approval for protection of <br />ripazian resources will be applied to roads and drill pads that are widtin the WIZ. They may also be applied to road <br />and drill pads that are adjacent to the WIZ, as needed, at the discretion of the Paonia District Ranger. It has been <br />shown through environmental analysis and the application of mitigation measures in the Conditions of Approval that <br />impacts to riparian resources will be reduced to an acceptable level and surface occupancy will not irretrievably <br />harm the resources. No other location for these facilities is practical because of other environmental constraints and <br />operational considerations. <br />C. No other waivers, exceptions, or modifications to lease stipulations are approved in this decision. <br />6. Proposed Actions That Are Denied <br />A. Construction of the soudtem 0.8-mile segment of the Long Draw Saddle Road that extends north from the Dry <br />Fork Road [o the intersection of the Upper Sylvester Road is not pemtitted. <br />7. Decisions that Are Deferred <br />A. More study is needed before a decision will be made concerning construction of Box Canyon Road, East Fork <br />Sylvester Road, and the spur roads and drill pads associated with these roads. These facilities would require <br />exceptions for No Surface Occupancy Stipulations for slopes over 60%, high geologic hazards, and riparian areas <br />for 4.3 acres. The 8 drill pads located on National Forest system lands that are affected by This decision deferral <br />include: <br />18-03 <br />18-04 <br />19-04 <br />19-05/19-06 <br />20-04/20-OS <br />21-05/21-06 <br />21-07/22-07 <br />22-OS <br />Drill pad 21-08, located on private land, is also affected by this decision deferral because access is across National <br />Forest System lands. <br />In order to proceed with analysis of activities in these areas, MCC will need to design and stake the locations of the <br />proposed facilities. The ID Team then could study the proposal in the summer of 2002, supplement the EA and <br />project record if needed, then recommend a decision during the fall of 2002 or winter of 2002/2003. MCC should <br />provide methane gas exploration data and an assessment of need for MDWs in this area. MCC should participate in <br />FS Interdisciplinary Team field review of the proposed locations of Facilities in areas restricted by lease stipulations. <br />Final Version 5/31/02 Page 5 <br />
