Submission of Incorrect or Iacomulete Information <br />Where the permittee failed to submit nay relevant facts is a permit <br />application, or submitted incorrect information in a perai.t <br />application or report to the Division, the permictee shall promptly <br />submit tie relevaat'applicatioa information whici vas not submitted <br />or nay additional information needed to correct any erroneous <br />information previously submitted. <br />5. Bypass <br />The permittee may alloy nay bypass to occur which does not cause <br />effluent limitations to be ezceeded, but if and only if Lt is for <br />essential maiateaaace to assure efficient operation. <br />Bypass is prohibited, and the Division may take enforcement action <br />against a permittee for bypass, unless: <br />a) Bypass vas unavoidable to prevent loss of Life, personal <br />injury, or severe property daaage; <br />b) There were no feasible alternatives to the bypass, such as the <br />use of auziliarq treatment facilities, retention of uatreatzd <br />waste9, or maiateaaace during normal periods of equipment <br />downtime. This condition is not satisfied if the permittee <br />could have installed adequate backup equipment to prevent a <br />bypass which occurred during normal periods of equipment <br />dowat'_me or preventative maintenance; sad <br />e) The permittee submitted notices as required in "Bypass <br />Notification", Part II.a.6. <br />6. Bvoass Notification <br />If the peraittee knows is advance of the need for a bypass, a notice <br />sha11 be submitted, at least tea days before the date of the bypass, <br />to the Division and the Baviroameacal Protection .~.geacy (EPA).
