(HGTI) and the Colorado Division of Minerals <br />and Geology (CDMG) met a[ the Hayden Gulch Loadout on February 1, 2005 to review CDMG <br />concerns regarding groundwater monitoring and the potential need for an additional upgradient well. <br />In response to this meeting, HGTI prepared an alluvial groundwater evaluation which showed that <br />regional alluvial groundwater quality is degraded and should be classified as "limited use and <br />quality." <br />CDMG generally concurred with HGTI's alluvial groundwater quality finding, however, in an <br />interoffice memorandum dated June 10, 2005, CDMG staff indicated the existing upgradient wells <br />used in the alluvial groundwater evaluation were not ideal to characterize upgradient Dry Creek <br />alluvial groundwater quality. Consequently, CDMG recommended in the 2nd Adequacy Comments <br />to Technical Revision No. 06 (TR-06) that HGTI install a new upgradient monitor well in the Dry <br />Creek alluvium immediately upgradient of the site and adjacent to Dry Creek. <br />In their responses to CDMG's 2nd Adequacy Comments, HGTI agreed to install a new upgradient <br />alluvial monitor well, HGDAL4, in the revision material submitted to CDMG on June 13, 2005. <br />HGTI also indicated that this well will be incorporated into the ongoing groundwater monitoring <br />program. <br />Mr. John Weinman, acting on behalf of HGTI, talked to Mr. Mike Boulay, of CDMG's staff, about <br />the status of this new upgradient alluvial well on October 18, 2005. Mr. Weinman explained to Mr. <br />Boulay that HGTI would like to defer installation until the Facilities coal handling modification <br />approved as part of TR-06 is constructed. Mr. Boulay, the Coal Program Specialist who prepared <br />the June 10, 2005 memo, indicated that thought the deferment was acceptable. Therefore, HGTI <br />respectively requests CDMG's permission to defer installation of new Dry Creek alluvial <br />monitoring well HGDAL4 until such time that HGTI moves forward with the 2,000,000 ton/year <br />coal handling upgrade. <br />P.O.
