Pursuant to Section § 4.1 of the CMLRD <br />Agreement, Rockcastle agreed to complete an engineering study <br />identifying any geotechnically and geomorphically unstable areas of <br />Pits 5 and 6. Pursuant to $ 4.2 of the CMLRD Agreement, Rockcastle <br />agreed to reassess the geotechnical stability of the potential <br />slope failure adjacent to the Pit 4 haul road. BasQd upon these <br />studies, and recommendations contained therein, Rockcastle agreed <br />to conduct, where necessary, appropriate reclamation measures. <br />In fulfilling its obligations pursuant to §§ 4.1 and 4.2 of <br />the CMLRD Agreement, please find the enclosed engineering studies <br />prepared by AC2, Inc. ("AC2"), on behalf of Rockcastle. Each study <br />is discussed briefly below. <br />Pit 5/6 -- Stability Analysis. <br />The enclosed stability study of the Pit 5/6 area indicates <br />that there are no significant geotechnical or geomorphic stability <br />problems at the Pit 5/6 area. Some areas of minor surficial <br />geomorphic stability were identified by ACZ. These localized areas <br />• of minor erosion do not constitute significant erosion problems. <br />However, Rockcastle will implement the reclamation measures set <br />forth more fully in the ACZ study to assure long-term site` <br />stability. <br />
