' <br />Dear Mr. Ponchak: <br />Ronald W. Cottony <br />Division Director <br />Natural Resource Trustee <br />On February 28, 2006, DMG approved the 110c application for the Upper Animas Sand and <br />Gravel operation. However, the permit will not be issued until DMG receives an appropriately <br />executed financial warranty. Any operator who commences mining activities before the permit <br />is issued may be found in violation of the Act and Rules for mining without a permit. <br />Pursuant to Rule 4.2.1(4), DMG has completed a reclamation cost estimation for the first year of <br />operations, totaling $7,618. Please find enclosed, 18 pages of summary, work sheets and data <br />sheets utilized by DMG to calculate the cost of reclamation. Please submit financial warranty for <br />the operation in an amount not less than $7,618. <br />The application indicates that approximately 400 cubic yards of 30-inch diameter riprap will be <br />utilized at the pit area to control erosion and ensure stability. The application anticipates that all <br />riprap materials are available within the affected land boundary.
