As we have also discussed, the entire permitted a
lays well within the boundaries of Mr. Di$ezza's land, a
therefore, notification of adjacent landowners is not re
-028
Mr.
the
reage
d
uired.
I am enclosing copies of page 4 of the Application hat has
been signed by Mr. DiRezza. In a similar fashion, I wil sign
this letter for Mr. DiRezza and then send along a copy a proved
by him as fast as mailing time allows. All has been pre iously
approved by Mr. DiRezza by telephone.
Exhibit B
l.) Enclosed are a series of photographs supplied by Mr DiRezza
that show the extent of the disturbance in Phases 3 & 4, and the
east end of Phase lA (close to the topsoil stockpile in he far
righthand corner). For the present Mr. DiRezza wishes t include
all phases as shown in Exhibit B-2, as part of the permi ted
area.
We recognize we will incur an obligation to reclaim
ways or working areas developed in Phases 3 & 4, during
of the permit. However, at this time the only area dist
Phases 3 & 4 since 1973, may be seen in the immediate fo
on the photos. That area measures less than 120' long a
100' wide adjacent to the east boundary of the permitte
I calculate the actual mined area to be less than 0.3 ac
the stockpile area (from where the photo is taken) to be
acres as described in Exhibit A.
In an effort to specify an existing obligation shou
area, Phases 3 & 4, be eventually deleted as mentioned i
original application, we would agree to reclaim a full o
plus any additional disturbance we may create for roads
working area in these two phases. Of course this entire
is mute'should Mr. DiRezza actually mine in Phases 3 & 4
such an event, all prior disturbance would be incorporat
the final reclamation process.
any road-
he life
rbed in
d about
acres.
es and
0.25+
d this
the
e acre
nd
matter
In
d into
Our only reason for inserting the foregoing reserv tion is
that the older disturbance beyond the foreground in the hotos
was worked over many years ago. We don't know if any mi eral
value remains and do not want to be obligated for reclam tion.
