r~ <br />U <br />Case No. 94CW036, Findings of Fact, Conclusions of Law and <br />Decree of the Court Approving Absolute and Conditional Cround <br />Water Rights, Plan of Augmentation and for Change of Water Rights, <br />Application of the City of Black Hawk, <br />Page 29 <br />senior water right from any and all decreed sources of water available to Black Hawk at the time of <br />the calls, including but not limited to those sources listed in Paragraph 19.6., above. <br />23.6. FRICO -Standley Lake shares. The FRICO -Standley Lake Division is an <br />integrated water division and delivery system, encompassing various structures including Standley <br />Lake, Croke Canal, Kinnear Ditch, and Bull Canal and other laterals, deriving their source of supply <br />from Clear Creek, Ralston Creek, Leyden Creek, Woman Creek and Coal Creek. The water rights, <br />described above in paragraph 19.6, within the Standley Lake Division, include both storage rights and <br />direct flow rights. The Court finds that the appropriate measure of the water rights listed in <br />paragraph 19.6(1) for the change by Black Hawk consists of a limitation on the storage rights based <br />on one annual filling of the Standley Lake storage decree, less carryover storage from the previous <br />year as determined by the Division Engineer, and a limitation on the direct flow rights based on <br />historic direct flow diversions. <br />• 23.6.(1) Storage Component. The Court finds that one annual filling ofthe <br />Standley Lake storage decree consists of 49,060 acre feet, less carryover storage from the previous <br />year as determined by the Division Engineer. Consequently, Black Hawk's pro rata portion of the <br />Standley Lake storage decree consists of 240 acre feet, less Black Hawk's carryover of FRICO <br />storage water from the previous year as determined by the Division Engineer. <br />23.6.(2) Direct Flow Component. The Court finds that direct flow water <br />historically was received into Standley Lake at an average of 5,861 acre feet per year with a maximum <br />annual total of 12,544 acre feet. Black Hawk's pro rata portion ofthe average annual historical direct <br />flow diversions into Standley Lake is equal to 28.7 acre feet. Black Hawk's pro rata portion of the <br />maximum annual historical direct flow diversion into Standley Lake is equal to 61.4 acre feet. Black <br />Hawk's pro rata portion ofthe direct flow component, as well as water obtained by Black Hawk from <br />sources other than its interest in the water rights listed in paragraph 19.6(1), shall not be counted as <br />carryover or against the one annual filling of the Storage Component. <br />23.6.(3) Transferred Divertible Yields. The transferable divertible yields, <br />into Standley Lake Reservoir and alternate points of diversion and storage, of Black Hawk's interest <br />in the water rights listed in paragraph 19.6(1), based upon a water year beginning November 151 and <br />ending October 31 ~' of the following years, are as follows: <br />Storage Component <br />Maximum annual = 240 acre-feet <br />. 20 year maximum = 3,167 acre-feet <br />
