Description of proposed change: By this paragraph 18.c., Black Hawk seeks <br />to change 52.1 inches out of the 5,710.64 inches in the Church Ditch (also known as the Golden City <br />and Ralston Creek Ditch (a carrier ditch). By this decree, Black Hawk seeks to change the <br />proportionate interests of 52,1 inches in the Church Ditch, listed in paragraph 18.b.(2)(a), above, to <br />allow for use of said water rights in the augmentation plan sought in this matter, and for other <br />purposes, as follows: <br />18.c.(l) Change of type of use: Black Hawk proposes to change the <br />decreed use of 52.1 inches in the Church Ditch from irrigation: to all municipal purposes, including <br />domestic, irrigation, industrial, commercial, fire protection, stockwatering, recreation, piscatorial, <br />storage and all other municipal purposes; to storage for later use for all the foregoing purposes; and <br />to use by exchange for all of the foregoing said purposes. The water will also be used for exchange, <br />for replacement, and for augmentation purposes, including augmentation pursuant to the decree <br />sought by this application. No appropriative right of exchange is sought to be decreed in this matter. <br />Applicant asks the Court to decree that Applicant has the right to use, reuse, successively use and <br />dispose of, by sale, exchange or otherwise use to extinction-all water lawfully diverted and/or <br />• impounded under the changed water rights after required return flows have been made.
