Cattany <br />Division Dlreeler <br />Natural Resource Trustee <br />Listed below are adequacy review comments on the above-captioned Regulaz 112 Application. <br />The decision date for your application is scheduled for July 13, 2004. Therefore, I would <br />appreciate a response from you on or before July 2, 2004. (Your response should include two (2) <br />copies). Please be advised that your application maybe deemed inadequate and maybe denied <br />on July 13, 2004 unless the following adequacy review items are addressed to the satisfaction of <br />the Division. <br />6.4.4 EXI3IBIT D - Minine Plan <br />1. On page 4 of the application the applicant proposes to operate an asphalt plant, a concrete <br />batch plant, and asphalt and concrete recycling equipment and operations. Please clarify whether <br />these will be new facilities or existing facilities, and whether they will be temporary or <br />permanent facilities remaining after final reclamation. <br />2. The applicant proposes on page 8 that Phase II(a) of the operation shall commence upon <br />approval of the Substitute Supply Plan (SWSP) and Gravel Well Permit by the State Engineer's <br />Office (OSE). Please indicate the status of each application and the expected approval date from <br />the OSE. In the event that the SWSP and Gravel Well Permit applications are not approved by <br />the Office of the State Engineer on or before July 13, 2004, the Division requests that the <br />applicant commit to the following measures: a) the operator will provide the Division with <br />evidence of written approval from the Office of the State Engineer of the required S WSP and <br />Gravel Well Permit for the Raindance Sand & Gravel Mine prior to exposure of groundwater, <br />and b) the operator will provide the Division with a signed affidavit that they had not exposed <br />any groundwater at the Raindance Sand & Gravel Mine prior to the necessary approvals from the <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
