Mr. Mark S. Loye
June 11, 1984
Page 2

applicant only requests approval for 2 acres at the
present time.
3. Exhibit A to the application is amended to provide
as follows:
A. The permit area is situate in portions of the
NW1/4NW1/4, NE1/4NW1/4, SW1/4NW1/4, and the
SE1/4NW1/4 of Section 34, Township 50 North, Range
1 West, N.M.P.M. in Gunnison County, Colorado,
with the center of the permit area situate at a
point from whence the northwest corner of said
Section 34 bears North 46° West 2,000 feet.
B. The mining plan, being Exhibit B, is modified
to provide that the only area disturbed will be in
phases I and II depicted thereon.
In response to your May 21, 1984 letter, we note the following:
4. There are no property owners immediately adjacent
to the permit area, and therefore no further notices
will be sent.
5. There are no permanent, man-made structures within
200 feet of the proposed permit area.
6. The operator does intend to salvage all available
topsoil for use in reclamation, and will replace topsoil
to a depth from 4 to 6 inches minimum over the entire
permit area.
In response to your May 25, 1984 letter, we note the following:
7. The issue of improper mining prior to permit issu-
ance will be addressed at the June meeting of the Mined
Land Reclamation Board.
8. We have written to the Colorado Division of Wild-
life, requesting their further review of this matter.
However, it is the applicant's position that the initial
review by the Division of Wildlife is adequate and com-
plete.
