2. The prehearing conference in this matter was originally set for June 2, <br />2006 in Fairplay, Colorado. <br />The Chair received the Motion by fax on June 1, 2006. The Motion <br />requested that the prehearing conference and formal Board hearing be <br />continued to a lafer.date to allow the Objectors more time to file witness ? ' : ~, <br />and exhibit lists. The Objectors asserted numerous grounds for the <br />requested continuance. <br />4. On June 1, 2006, following the filing of the Motion, the Applicant <br />submitted an email communication to the Division withdrawing its request <br />for a June 2, 2006 prehearing conference and agreeing to extend the <br />application review period until August 30, 2006. <br />5. The Applicant's letter of withdrawal renders the Motion moot with respect <br />to the prehearing conference scheduled for June 2, 2006. <br />6. Construction Materials Rule 2.7.1(5) requires that a prehearing conference <br />be held at least ten calendaz days prior to the formal Boazd hearing. <br />7. Because a prehearing conference cannot now be held at least ten calendaz <br />days prior to the Boazd's upcoming June 14-15 meeting, the Motion is <br />rendered moot with respect to the formal Boazd hearing in June. <br />8. After consulting with representatives for the Applicant, the Objectors and <br />the Division, it was determined that at least one representative from all <br />parties could attend a prehearing conference on June 15, 2006 at 6:30 PM <br />in Fairplay, Colorado. <br />9. It is not appropriate to deny the Applicant's application. <br />
