M-2005-080 ~ ' `• ~ =~~ <br />THIS MATTER came before the Chair of the Colorado Mined Land <br />Reclamation Boazd ("Boazd") for a ruling on a Motion for Continuance ofPre-hearing <br />Conference and Board Hearing, or in the Alterative, That the Application be Denied <br />("Motion"). The Motion was filed on behalf of Robert White, Kent Rolf, Curt Sayer and <br />Fred Wisely ("Objectors") in a matter involving a reclamation permit sought by the Allen <br />Drilling and Excavating Company, LLC ("Applicant"). The file number in this matter is <br />M-2005-080. Sheela Stack of Harvey W. Curtis and Associates submitted the Motion on <br />behalf of the Objectors. Tanya Light represented the Division of Minerals and Geology <br />on issues related to the Motion. Joe Middleton represents the Applicant. <br />The Boazd Chair, having considered the Motion and having been <br />otherwise fully informed of the facts in this matter, hereby enters the following findings <br />of fact, conclusions of law and order: <br />The Boazd has jurisdiction over the parties and the subject matter of this <br />proceeding pursuant to Sections 34-32.5-105,34-32-105 and 34-32.5-114, <br />C.R.S. (2005). The Board's Chair has the authority to rule on this Motion <br />pursuant to Sections 34-32.5-105, 34-32-105(2) and 24-4-105, C.R.S. <br />(2005). <br />
