Application Due Dates (continued) <br />One original and two copies of the completed dischazge application form shall be submitted, by certified trail or hand delivery, to: <br />Colorado Department of Public Health and Environment <br />Water Quality Control Division (WQCD-P-B2) <br />4300 Cherry Creek Drive South <br />Denver, Colorado 80246-1530 <br />5. Certification Procedures <br />If the general permit is applicable to the applicant's operation, then a certification wil! be developed and the applicant will be <br />certified under this general permit. <br />a. Request for Additional Information: The Division shall have up to thirty days after receipt of the above information to <br />request additional data andlor deny the authorization for any particulaz dischazge. Upon receipt of additional information, <br />the Division shall have an additional thirty days to issue or deny authorization for the patticulaz dischazge. (Notification of <br />denial shall be by letter, incases where coverage under an alternate general permit or an individual permit is required Mead <br />of coverage under this general permit) <br />b. Automatic Coverage: If the applicant does not receive a request for additional information or a notification of denial from <br />the Division dated within thirty days of the receipt of the application by the Division, authorization to discharge in <br />accordance with the conditions of this permit shall be deemed granted. <br />c. Individual Permit Required: L; after evaluation of the application (or additional information, such as the SWMP), it is found <br />that this general permit is not applicable to the operation, then the application will be processed as one for an individual <br />permit. The applicant will be notified of the Division's decision to deny certification under this general permit. For an <br />individual permit, additional information maybe requested, and 180 days will be required to process the application and <br />issue the perarit Temporary coverage under this general permit may be allowed until the individual permit goes into effect. <br />d. General vs. Individual Permit Coverage: Any owner or operator authorized by this permit may request to be excluded from <br />the coverage of this permit by applying for an individual CDPS permit. The owner or operator shall submit an individual <br />application to the Division, with reasons supporting the request. <br />6. Permit Certifications, Applicable Sections: <br />The individual certification prepazed for each applicant will indicate whether Part I.B of the permit which rrtust be followed by that <br />applicant. Part LC must be followed by all pertnittees unless exett>pted as outlined in Section III.C of the Rationale. (In the absence <br />of such indication from the Division, the permittee will be responsible for deterrni*±ing and then coiriplying with the applicable <br />sections in Part I.) In addition, all permittees will be required to comply with Part I, subparts A, D, E and F, and all of Part II of the <br />permit <br />Permit Expiration Date <br />Authorization to dischazge under this general permit shall comtnence on October 1, 2002, and shall expire on September 30, 2007. <br />The Division must evaluate and reissue this general permit once every five years, and must recertify the applicant's authority to <br />duchazge under the genera] permit at such tune. Therefore, any permittee desiring continued coverage under the general permit <br />must reapply by March 31, 2007. If the permittee's individual cemfication does not indicate that Part l .B of the permit must be <br />followed (i.e., the certification is for stormwater dischazges only), the permittee must reapply by June 30, 2007 if they desire <br />continued coverage under the general permit. The Division will initiate the renewal process; however, it is ultimately the pettnittee's <br />responsibility to ensure that the renewal is submitted. The Division will determine if the applicant may continue to operate under the <br />terms of the general permit. An individual peraut will be required for any facility not reauthorized to discharge under the reissued <br />general pem¢t. For facilities wishing to terminate authorization under the new permit, provisions of Part II.B.S.d will be applicable. <br />8. Inactivation of Certification <br />The permittee may request inactivation of their certification under this permit, once the site has been fully released from their <br />reclamation bond requuemenu by the Colorado Division of Minerals and Geology (CDMG). See Part II.B.S.d of the permit <br />
