C-91-024 <br />Dear Steve: <br />~.i ' !~']' i.. .. <br />/ After investigating the circumstances of the initial construction <br />/// of the Fruita #1 Mine bench area, it has become apparent that the <br />entire bench area was constructed prior to August 3, 1977. I have <br />contacted a number of people who were involved with the operation <br />at that time and I have received letters describing their <br />recollection of the construction. Although these letters do not <br />• scientifically prove that the bench area was built prior to the <br />8/3/77 date, the cumulative effect of the letters is strong. Actual <br />dated pictures or written evidence is simply not available. <br />The following information was obtained and is enclosed: <br />1) Letter from Al Hoyle to Steve Renner on October 30, 1991 which <br />discusses a number of facts and dates that indicate the bench area <br />was constructed prior to S/3/77. The most significant piece of <br />evidence is the letter from Coal Partners to the USGS on June 17, <br />1977 which stated" we commenced roads and preparation of outcrop <br />entry sites on the Anchor and Cameo seams on the fee land we <br />control as per our mine plan submitted February 24, 1977." <br />2) Second letter from Al Hoyl to Steve Renner on December 4, 1977 <br />with additional information on the actual mine startup. <br />3) Letter from Randy Denison, the earthwork contractor who was <br />involved with the actual bench construction at the time. He states <br />" a substantial amount of work was done on the Fruita Coal Mine <br />prior to August 3, 1977." <br />4) Letter from Charles Silengo (General Manager of Operation) to <br />the Mine Safety and Health Administration dated June 23, 1979, <br />which states We are driving rock tunnels now and hope to be in <br />i <br />~/~Nl~. <br />•1 <br />67cr! <br />
