Schriener <br />Division of Minerals & Geology <br />December 6, 1993 <br />Page 4 <br />Once the equipment is disposed of by the Court, It is still necessary to remove roads and <br />foundations that would interfere with reclamation, scarify the soil, replace topsoil, and seed. These <br />are legitimate bonding items and we have included these in our Exhibit L. <br />As stated in the Mining and Reclamation Plan, the owners/operators will disturb a maximum of 108.2 <br />acres, which is a decrease of five acres from our original application. The operators will not have <br />any more than 108.2 total acres mined, disturbed, or in use at the processing area at any one time. <br />We have not requested 170 to 200 acres to be disturbed because reclamation will be occurring <br />simultaneously as the mining operation proceeds. For example, if 200 acres have been mined <br />(excluding the processing site of 35 acres) only 73.2 acres will be in a disturbed state while the other <br />9'I.8 acres will have been reclaimed. We hope this addresses your concerns. <br />A. Phase I-VIII <br />Maximum disturbed area equals 108.2 acres (Please see the revised estimates attached L-1 <br />through L-5). <br />B. Plant Processing Site <br />(See the revised estimate attached Sheet L-3). <br />C. Rell Spur <br />Upon mining completion, the rail spur will not be removed. These railroad tracks will become <br />a permanent and integral part of the Amity area and will be used for other purposes per the <br />owners' needs so no costs for rail spur removal is necessary. The field conveyor will be <br />removed (See line item under revised estimate for processing site). <br />D. Indirect Costs <br />The indirect costs were originally not computed at 20.8%. They are now calculated correctly <br />(See L-4). <br />
