We are contesting his ownership of anything.
VVith regard to impacts to groundwater, please recall this is a wet mining operation so there is no
opportunity to drawdown the water table. The water in the lake will be at the same elevation as the
water table. The groundwater elevation around the lake will remain static.
MO. 2 WATER RIGHTS
Our Exhibit G provides evidence that sufficient water rights held by the applicant exist to meet the
operational and evaporative needs of the mine and reclaimed land.
A substitute water supply plan was applied for through the Colorado State Engineer's Office on
October 14, 1993 (See Attachment A). In this letter and application, it is requested that farm
irrigation water be used to meet operational water needs. Also this application explains how certain
vvater rights owned by the owners shall be used to comply with Senate Bill 120.
In all our past applications, the above information has been adequate for permit approval and we
request that it also be accepted here.
11990 Grant Street, Suite 410 • Denver, Colorado 80233 • (303) 452-6611 • Fax (303) 452-2759
