<br />Reclamation of the structure will include: <br />• Rerrioval of Rip-rap <br />• Removal of Culverts <br />• Grading Slopes <br />• ~ Topsoil replacement and revegetation <br />The.division previously approved a reclamation cost of $5,000.00 for the <br />reclamation, of the Bdyd Pit Low Water Crossing in Loveland, CO, permit M- <br />2000-122. The size and type of crossing is very similar to this one and therefore <br />a bond of $5,000.00 would be appropriate.. <br />b) <br />Asphalt Specialties Co Inc. (ASCI) is currently negotiating. surface agreements <br />with oil and gas companies on the property. ASCI expects to secure agreements. <br />that will include the language in Paragraph (a) "Provide notarized agreement <br />between the applicant and.the person(s) having an interest in the structure. that <br />the applicant is to provide compensation for any damage to the structure" In the <br />event such an agreement cannot be reached, ASCI will provide a geotechnical <br />slope stability report that will demonstrate.that such structures shall not be <br />damaged by mining activities (Paragraph b). Until such time as surface <br />agreements are executed or a geotechnical slope stability report is approved by <br />the Division, ASCI will maintain a setback of 200 ft from said structures. <br />3.' Exhibit G Water Information <br />ASCI will not expose any additional groundwater until a Temporary substitute <br />supply plan is approved by the State Engineers Office. <br />4.
