<br />_~_ <br /> <br />EXHIBIT R - Proof of Filing with County Clerk and Recorder (Rule 6.4.18): You must submit an <br />affidavit or receipt indicating the date on which the application was placed with the local County Clerk <br />and Recorder. <br />EXHIBIT S -Permanent Man-M1iade Structures (Rule 6.4.191: The Division cannot accept a <br />statement that the owner is currently trying to locate the owner of the gas pipeline, nor can the Division <br />accept the statement that the owner is currently trying to locate the owner of the iREA Easement. You <br />must provide information sufficient to demonstrate that the stability of any structures located within <br />two hundred (200) feet of the operation or affected land will not be adversely affected. You may either <br />provide: <br />I J Evidence of an agreement with the owner of the pipeline and the IREA structures that will <br />compensate the owners of the structure in the event the operation damages the structure. <br />2J An engineering evaluation that adequately demonstrates to the Division that the proposed <br />mining and reclamation operations will not result in damage to the structures. This <br />requiremerrt may be met by providing the Division a letter from the gas pipeline owner and <br />IKEA and/or the people that maintain the structures affirming no anticipated impact to the <br />structure by the proposed operation. <br />Please be sure to place all information submitted to the Division with the Arapahoe County Clerk and Recorder <br />and submit a receipt to the Division as proof of filing with the Courrty Clerk and Recorder. <br />Your application will not be considered submitted until the information listed above is received and found <br />sufficient to begin our review. A decision date will be established 90 days from the date of receipt of all of the <br />requested information. Additionally, if you have already published notice you will need to republish notice, <br />after the Division considers the application submitted. This notice must be published once a week for four (4) <br />consecutive weeks, starting within ten (10) days of the date your application is considered submitted. We will <br />notify you when you should initiate republication of your notice. The final date for receiving comments is the <br />20th day after the fourth publication or the next regular business day. <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application. The <br />Division will review your application to determine whether it is adequate to meet the requirements of the Ad <br />after submittal of all required items. <br />Sincerely, <br />Barbara D.
