<br />Jim Dillie <br />Division of Minerals and Geology <br />May 25, 2000 <br />Page 2 <br />Present indications are that it will take 3 years to effectively secure the water augmentation <br />plan proposed. In that 3 years a total of I S acres will be trained and 60 acres stripped for <br />backfilling for a total of 75 acres. When the augmentation plan is complete, the operator <br />will present an augmented reclamation with a lake as final reclamation and request bond <br />reduction at [heat time. The overburden material will then be used as proposed in the permit <br />application to extend the flood control dikes or other purposes fitting with the operation. <br />5. Exhibit D -Item #4 above explains the operator's plan to backfill the (3) three 5 acres <br />cells at the end of the (3) three year period for a total required till of 15 acres. At this time <br />if the water augmentation plan has not been approved, backfilling of the lakes will begin, <br />and the operator will resubmit a reclamation plan and a revised reclamation cost fur bonding. <br />However with that said it is most likely that the water augmentation plan will have been <br />approved and the operator will ask. for a reduction of the reclamation bond to reflect the <br />lesser cost of reclaim. <br />6. Exhibit E -The operator does choose to leave a lake for recreation and the final <br />reclamation program with the slopes graded to 3:1 from 5 feet above to 10 feet below the <br />water line. The operator will not allow any swimming in this private lake so the proposed <br />backslopes will be adequate. <br />7. Exhibit G -The operator does expect notification from the Division of Water Resources <br />shortly that a temporary substitute supply plan has been issued. This will permit mining of <br />the pit as proposed and the bond proposed will be sufficient to backfil{ the pit above water <br />level. As stated earlier. When the Vltater Court issues the permanent plan, reclamation will <br />dren be changed to a lake and the bond modified accordingly. <br />
