located in Section 34, Township 3 North, Range 67 <br /> West , 6 th P.M. , Weld County, Colorado, on the North <br /> side of St . Vrain Creek, and the date of appropriation <br /> of the structure is January 1 , 1860. <br /> 4 . Statement of the Plan for Augmentation: <br /> a . General Description: <br /> Applicant is presently conducting a sand and gravel <br /> mining operation on portions of the Northwest quarter, <br /> Section 31 , Township 3 North, Range 67 West , 6th P.M. <br /> Weld County, Colorado. As a result of the removal of <br /> surface and subsurface materials, the groundwater <br /> table in the area has been intercepted anal exposed. <br /> This has resulted in the evaporation of water which <br /> would normally be a part of the St . Vrain Creek <br /> Alluvium. During the active mining stage of the <br /> operation, Applicant also intends to use water from <br /> the on site ponds to control excessive dust in the <br /> construction area . It is expected that the <br /> application of water in this fashion will result in <br /> some evaporation of the water which is removed from <br /> the ponds . <br /> b. Augmentation Needs: <br /> At the present time, there are approximately 26 acres <br /> of finished pond surface and an additional 12.8 acres <br /> of temporary ponds which are used in conjunction with <br /> the sand and gravel mining operation. It is <br /> anticipated that when completed, the total area of <br /> exposed ground water will increase by approximately 59 <br /> acres . This Plan for Augmentation is designed to <br /> provide replacement water for the stream depletions <br /> associated with the above described operation. To th <br /> extent that the Court determines that additional <br /> augmentation water is required, a Supplemental Plan <br /> for Augmentation will be filed with the Court Clerk. <br /> C. Operation and Administration of the Plan: <br /> Applicant , in order to prevent injury to vested senior <br /> water rights as a result of any out of priority stream <br /> depletions associated with the sand and gravel <br /> operation, will discontinue usage of the irrigation <br /> well decreed in Case No. W-7551-73. Historically, <br /> water from said well has been used to irrigate 72 <br /> acres of pasture grass located in the S 1/2 NW 1/4, <br /> Section 31, Township 3 North, Range 67 West , 6 th <br /> P.M. , Weld County, Colorado. The historically <br /> irrigated acreage has been permanently been taken out <br /> of production as a result of the sand and gravel <br /> mining operation referenced above. Engineering <br /> calculations, using the Modified Blaney-Criddle <br /> method, indicate that each acre of irrigated land <br /> historically has consumed at least 1 .63 acre feet of <br /> water, for a total of 117. 3 acre feet . <br /> WHEREFORE, Applicant requests that the Court enter Findings <br /> of Fact , Conclusions of Law and a Decree approving the Plan for <br /> Augmentation and Change of Water Right described herein. <br /> -2- <br />
