DIV&uu ci <br /> AND RECLAMATION AGREEMENT <br /> THIS AGREEMENT is entered into this Z�f_ day of <br /> L <br /> 1974 by and between THE STATE OF COLORADO, by and through its Director of <br /> Natural Resources and the Land Reclamation Board (hereinafter referred to <br /> as "State") and PASQUALE VARRA, d.b.a. VARRA ENTERPRISES (hereinafter <br /> referred to as "Varra"). <br /> W I T N E S S E T H: <br /> WHEREAS, Varra desires to operate a sand and gravel mine in <br /> Section 31, T3N, R67W, Weld County, Colorado; and <br /> WHEREAS, Varra has submitted a plan on the Proposed Land <br /> Stabilization and Reclamation Procedures for the proposed sand and gravel <br /> mine operations; and <br /> WHEREAS, said sand and gravel mine will be operated for the <br /> purpose of extracting sand gravel for commercial marketing; and <br /> WHEREAS, The Colorado Open Mining Land Reclamation Act provides <br /> statutory authority for the Land Reclamation Board of the State of <br /> Colorado to enter into agreements with operators or persons in charge <br /> of mining operations such as those contemplated by Varra to insure that <br /> the necessary stabilization and reclamation work will be done to prevent <br /> i <br /> landslides, floods or erosion. This section of the law further provides <br /> that the Land Reclamation Board requires a performance bond conditioned <br /> upon the faithful performance of the stabilization work required by the <br /> Board; and <br /> WHEREAS, the Land Reclamation Board has determined that the <br /> mining operation to be conducted by Varra in said Section 31 could have <br /> an adverse affect on the environment and could result in landslides or <br /> erosion if proper stabilization and reclamation procedures are not <br /> followed. <br /> NOW THEREFORE, pursuant to the authority set forth in the <br /> Colorado Open Mining Land Reclamation Act, the Land Reclamation Board <br /> of the State of Colorado has determined that the following land <br /> J <br />
