The relocation of the Third Creek channel will also be a <br />part of final engineering design. We dq not see any <br />problems in preparing plans detailing haw Third Creek flaws <br />will be handled. Design of channel rundowns and overflow <br />spillways will be done to UDFCD standards and sub,7ect to <br />their review. The relocation of Third Creek will replacE~~ <br />the existing channel with a byoasa channel around the plant <br />site that will actually have better capacity than the <br />pr^esent one. <br />In summary Uave, we feel that we can meet the UDFCU~s comments <br />and concerns. We realize that any drainage work will be sub~e~et <br />to their review and appr•gval. HgwevQr•, at this time, it is not <br />reasonable to expect an applicant to expend a huge sum of money <br />on engineering without arty assurance that he can even proceed <br />with mining.
