This application is far^ a <br />permit to min©. If approved, wo will pt•epar^e final <br />engineering plans detailing the improvements and protectlort <br />that will be constructed. The locations and number of <br />spillways are approximate and are based on past mining plan=_~ <br />of similar scope along the 6outh Platte River. We feel it <br />is appropriate to only go into the stage of fine]. <br />engineering once permits have been aoor•oved. Otherwise the <br />expenditure of time and money buys the applicant nothing. <br />5. We concur- with allowing a maintenance easement far• the <br />UDFCD. There will also be a 25 foot easement for the South <br />Platte River trail, which we assume will be available far• <br />driving maintenance vehicles slang. <br />6. Third Creek, like any drainage is a problem, but we do net <br />see it as a rna,7or problem. Any' development that takes plar_F_+ <br />uostr•eam should be responsible for- developing adequate <br />drainage facilities and detention ponds. Regardless of what <br />the final hydrology report for the area is, we shauld net be <br />expected to be responsible for other development in the~> <br />area. Our• pr•o~ect should be able t~~ safely control cur•r•ent <br />levels of runoff with some prevision far an increase in <br />volume in the future. AJpstr•eanr development shauld be <br />responsible for maintaining historic peak. discharges. <br />7. We cancer that consideration should be given to design on <br />water entering and leaving the lakes. We actually see this <br />as an apportunity far the UDFCD to control drainage on a <br />regional level. The original FNAD done by Gingery <br />calculates aporoxirnately 1,500 acre-feet of runoff generated <br />by Third Creek during a 100 year storm. The lakes createel <br />by mining will have a total storage rapacity of <br />approxirnately 800 to 900 acre-feet above the normal water <br />surface elevation. These lakes would serve as a nra~or• <br />detention facility that would regulate the release of water <br />to the South Platte which should be beneficial. FInal <br />engineering does need to be done on a channel rundown intca <br />the lakes ar~d the overflow spillway inter the South Platte. <br />Again, we do n~~t feel it is appr•opr•iate tc~ expend fees on <br />final engineering design before a permit is obtained. These <br />plans and details will be prepared once we ar•e assured that <br />mining is permitted. <br />
