~Ms. Brent Kerr <br />April 16, 2007 <br />Page 4 <br />6. The Water Commissioner responsible for the administration for this plan is Jim Boyd <br />(see address & phone # in item 2 above). The Applicant shall maintain daily records <br />of all diversions, replacements, and the amount of water used for each particular <br />purpose. The Applicant shall provide a report of these records to the Division <br />Engineer and the Water Commissioner on a monthly basis on a form approved by <br />them. The accounting shall be submitted within thirty (30) calendar days of the end of <br />the month for which the accounting is being made. <br />The proposed replacement source for the depletions accruing to the Gunnison River <br />resulting from this mining operation is a proposed lease agreement with the Bureau of <br />Reclamation for stored water in Blue Mesa Reservoir. This lease agreement should <br />include sufficient additional water as will be necessary to account for transit losses <br />between the augmentation location and the Anderson Pit. Applicant will be required <br />to submit an executed lease agreement with the Bureau of Reclamation prior to <br />exposure of any groundwater. Approval of this plan is subject to submission of <br />a copy of that executed lease agreement to the Division Engineer and Water <br />Commissioner for each year of this approval prior to expiration of the previous <br />(ease. <br />S. Replacement water is to be supplied from Blue Mesa Reservoir and will be <br />released/delivered according to the schedules included in this plan (see attached table <br />5: Steady State Lake Lagged Depletions and attached table titled: Maximum Monthly <br />Distribution for Depletion & Replacement Requirements) subject to modification by the <br />Division Engineer or Water Commissioner. <br />9. All releases of replacement water must be sufficient to cover all out-of-priority <br />depletions in time, place, and amount and must be made under the direction and/or <br />the approval of the Water Commissioner. The release of replacement water may be <br />aggregated to maximize beneficial use. The Water Commissioner and/or the Division <br />Engineer shall determine the rate and timing of an aggregated release. <br />10. The water attributable to the 34 shares of the Bona Fide Ditch must continue to be <br />diverted in-priority at the ditch headgate, and then measured back to the North Fork of <br />the Gunnison River in the vicinity of the Anderson Pit. Adequate measuring devices <br />acceptable to the Water Commissioner must be installed. <br />11. The replacement water that is the subject of this plan cannot be sold or leased to any <br />other entity. As a condition of subsequent renewals of this substitute water supply <br />plan, the replacement water must be appurtenant to this site until a plan for <br />augmentation is obtained. All replacement water must be concurrent with depletions <br />in quantity, timing, and locations. A copy of this approval letter shall be recorded with <br />the Delta County Clerk and Recorder. <br />12. All diversions for dust control, concrete hatching, asphalt production, and sanitary <br />purposes at the facility shall be measured in a manner acceptable to the Division <br />Engineer. The Applicant shall install and maintain such measuring devices as <br />required by the Division Engineer for operation of this SWSP. <br />
