Ms. Brent Kerr <br />April 16, 2007 <br />Page 3 <br />As required by Section 8 of Senate Bill 89-120, this substitute water supply plan has been <br />provided to an outside consultant for review. The consultant has recommended approval of the <br />plan by way of a draft of this letter. Based upon statutory requirements and the recommendations <br />of the consultant, I hereby approve the proposed substitute water supply plan in accordance with <br />Section §37-90-137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of April 16, 2007 through April 15, 2009 unless <br />othervvise revoked, modified, or superseded by decree. If this plan will not be made <br />absolute by a water court action by the plan's expiration date, a renewal request must be <br />submitted to this office with the statutory fee by January 15, 2009. <br />2. Provide the name, address and phone number of the person who will be responsible for <br />the operation of the plan to this office, the Division Engineer (PO Box 456, Montrose, <br />CO, 81402, telephone 970-249-6622), and the Water Commissioner (Jim Boyd, PO Box <br />783, Cedaredge, Colorado 81413, telephone 970-856-3527) within 20 days of the <br />receipt of this approval. <br />3. A well permit must be issued for the gravel pit in accordance with Section §37-90-137(2) <br />and (11), C.R.S. prior to the exposure or use of groundwater. A well permit application <br />was previously submitted to this office under receipt no. 532967 and this application is <br />pending evaluation. Until a gravel pit well permit is approved, consumptive use and <br />exposure of groundwater on this site is prohibited. The provisions of §37-90-137(2) <br />C.R.S. prohibits the issuance of a permit for a well to be located within 600 feet of any <br />existing well, unless the State Engineer finds that circumstances so warrant after a <br />hearing held in accordance with the procedural rules in 2CCR402-5. This hearing may <br />be waived if you are able to obtain statements from the owners of all wells within 600 <br />feet, verifying that they have no objection to your use of the proposed well. Should a <br />new well permit be denied for reasons of 600 foot spacing, or any other legitimate <br />reason, approval of this SWSP will be cancelled. <br />4. The total surface area of the groundwater exposed at the Anderson Pit must not exceed <br />0.6 acres during the approval period of this SWSP and the maximum annual evaporative <br />loss shall not exceed 1.88 acre-feet. The annual amount of water used at the operation <br />shall not exceed 2.58 acre-feet for dust control, 2.01 acre-feet for concrete hatching, <br />0.14 acre-feet for asphalt production, 0.28 acre-feet for sanitary purposes at the <br />facility, and the total product mined shall not exceed 227,250 tons per year below the <br />groundwater surface resulting in 6.70 acre-feet of water lost with the product. If it is <br />anticipated that the total water surface area at the pit, or the amounts of water used <br />operationally exceed these amounts prior to the expiration date of this SWSP, an <br />amendment will need to be approved by this office prior to such expansion. <br />5. Approval of this plan is for the purposes as stated herein. This office must first <br />approve any additional uses for the water. Any future additional historic consumptive <br />use credit given (e.g., agricultural water transfer) for this site must consider all <br />previous credits given. <br />
