Exhibit "S" provides a copy of a letter from Western <br />Plains Energy to the Barnhart Agency regarding there desire of a minimum 50 foot setback <br />from their structures as well as other considerations during the mining phase. Please <br />provide a statement that ensures that Baculite Mesa LLC is willing to compensate for any <br />damages to the Western Plains Structures during mining and/or reclamation of the Baculite <br />~~ Mesa Pit. <br />Also, please indicate if mining will occur within 200 feet of powerlines owned and operated <br />by KOAA or KCSC-TV of Pueblo.
