Long <br />/ Division Director <br />RE: Adequacy Review -Baculite Mesa Pit <br />112 Construction Materials Permit Application, File No. M-97-011 <br />Dear Mr. Orr: <br />I have reviewed your February 19, 1997 Baculite Mesa Pit 112 permit application for 1970 <br />permitted acres and have listed my adequacy comments below. We leave not received any <br />public comment on the application. Assuming no comments are received within the public <br />comment period we should be able to reach a decision on your application by April 18, 1997 <br />Therefore, please respond on or before April 11, 1997. <br />Fi" 1. Public Notice Requirements. Please submit proof of publication and proof of notice to all <br />~' owners of record of surface rights and all owners of record of lands that are within 200 feet <br />~~ ~ ~ of the boundary of the affected land. <br />r>/' <br />2. Ma>amum Disturbance. The application states that no more than 40 acres will be <br />q~~ disturbed at any one time. The Division recommends that you consider a method or methods <br />to be used to ensure that all disturbances will be within this acreage limit. Please comment. <br />3. Nussbaum Spring. Exhibit "G" states that the surface or groundwater systems in and <br />'i,,'~" ,~ surrounding the Baculite Mesa Pit will not be adversely affected. If possible, please indicate <br />~}~' ; 7- the bottom pit elevation to be expected and its relationship to the elevation of the static water <br />~ ~ ' •'` level of the Nussbaum Spring. , , <br />~ 4. Seedbed for Revegetation. The mining plan states that the geologic strata beneath the <br />~~~- aggregate deposit is sandstone. Please indicate whether all 20-40 feet of aggregate will be <br />DID removed exposing the sandstone as a seedbed for revegetation or whether a buffer of 12 to <br />18 inches of aggregate will be left undisturbed. <br />5. Reclamation Cost. The reclamation cost of $60,076 proposed in Exhibit "L" is adequate. <br />However, please note that the cost of backsloping implies a highwall no more than 1480 <br />0~ linear feet. Therefore, the Division will expect that the operator expose no more than 1480 <br />linear feet of highwall at any one time. Please comment. <br />
