Long <br />Division Director <br />RE: Adams County RV Park, LLC, dba 124`h Estates Partners, File No. M-2001-085 <br />124'h Estates Sand & Gravel Mine 112 New Permit Application- Adequacy Review #2 <br />Dear Mr. Ewegen, <br />The Division received your adequacy response for the 124' Estates Sand & Gravel Mine dated October <br />30, 2001. The Division has a few remaining concerns that need to be addressed prior to approval of the= <br />application. <br />The applicant states that any discharge into the Fulton Ditch will ba in accordance with the . <br />Crossings Agreement. executed between the Fulton Ditch Company and Dacoa, Inc. Please be awaze . <br />that all agreements need to be established between the applicant, which is Adams County RV..Park, <br />LLC, dba 124a'Estates Partners. Dacoa, Inc. is neither the applicant nor the permittee, therefore, the <br />Division cannot accept any agreements unless they are execute by Adams County RV Pazk, LLC, <br />dba 124's Estates Partners. <br />2. The applicant revised the seed mixture to include Western Wheatgrass, Sideoats Grama, Needle and. <br />Thread, Streambank Wheatgrass and Slender Wheatgrass. Please specify the quantity of each species <br />to be planted in LBS PLS/acre. <br />The applicant acknowledges that shallow wells along 124`s Avenue and the water ski club pond will <br />likely be impacted by dewatering of the mine site. The applicant proposes a mitigation plan to <br />address the impacts to the wells and the pond. Please clarify the following regarding the mitigation <br />plan; <br />The applicant implies the dewatering into the Fulton Ditch will recharge the groundwater down <br />gradient of the mine. However, the applicant also states that the Fulton Ditch has likely sealed <br />itself by the settling of fine solids, which create a lining for the ditch. Please clarify if the Fulton <br />Ditch is lined to allow a recharge to the groundwater system, or lined to prevent seepage through <br />the ditch. <br />The proposed mitigation plan states that following mining and lining of the water storage <br />reservoir, the applicant will continue to monitor groundwater levels in the water ski club pond. <br />The applicant will need to clarify the frequency and duration that the water level in the pond will <br />
