The basis for this section of this certification is Mined Land Reclamation Division letter, July 13, 1984, RE <br />Professional Certification. <br />])1 Astatement of the professional qualifications of the certifvine professional. <br />Mr. Baccari was graduated from the University of Wyoming with a Bachelor Degree in General Engineering in 1964, <br />and from the University of Wyoming with a Master of Science Degree ut Civil Engineering in 1965. His pertinent <br />experience includes planning, design, and construction supervision of small and medium dams, drainage structures, <br />and spillways. He has been responsible for surface and ground water hydrology studies and storm routing smdies. <br />He is a registered Professional Engineer in the States of Colorado, Wyoming, Utah, Arizona, and Montana. <br />A citation of the Rule repuirine the certification. <br />The requirements for this certification are Rules 4.05.9 (]0) and (I l) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. <br />A,specific description of the subject of the certification. <br />The subject of this certification is a sedimentation pond, and concerns items (a) through (e) presented above. The <br />structure is an earth embartlattent. Appurtenant swctural elements include a primary spillway [corrugated metal pipe <br />(CMP) trickle tube provided with a steel box riser with bafFle boards] and an emergency spillway (earth). The pond <br />is identified as Pond Number 001 in Permit Number C-S1-026. This permit is to conduct a muting operation known <br />as the Canadian Strip Mine for the purpose of exvacting coal, and was issued to SLURCO Corporation (current). <br />The Canadian Strip Mine (including the subject pond) is located in Jackson Cotmry, State of Colorado, in Township <br />8 North, Range 78 West, 6th Prime Meridian, approximately 9 miles west of Walden, Colorado. <br />This certification is limited to the scope of Rules 2.05.9 (10) and (I1) as regards the existing sedimentation pond, and <br />is based on the Pond I Dam Cross Section and other information provided on the Mining and Reclamation Plan, <br />Figure 2, dated Mar. 30, 1981; Stage-Storage Curve Sedimentation Pond Nl, Figure Q-3, dated l (/29/94. This <br />certification does not extend to verification that this information and other information found in the Permit represents <br />existing conditions in the field, nor that the swcmre was designed, built, or operated N compliance with Rules 4.05.2 <br />through 4.05.9 of Colorado Mined Land Reclamation Division regulations. <br />l42 A statement of the actions taken in preparing the certification. <br />The following were reviewed: Rules 4.05.9 (10) and (11) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining; Mined Land Reclamation Division letter July 13, 1984, Re: Professional <br />Certification; the 4th quaner 1996 inspection report and 1996 annual certification; the 1997 quarterly inspection <br />repotts; permit documentation including the Mining and Reclamation Plan, Figure 2, dated Mar. 30, 1981, and the <br />Stage-Storage Curve Sedimentation Pond ql, Figure Q-3, dated 11/29/94; the Dam Safety Manual (State Engineer's <br />Oftice, June 3, 1983); and CCR 402-1, Rules and Regulations for Dam Safety and Dam Construction. Measurements <br />of selected physical parameters of the pond were made with an Abney level, cloth tape, and compass. <br />A statement of pertinent professional observations and conclusions made during the completion of the <br />certification. <br />There were no indications of structural weakness, erosion, or hazardous conditions. <br />Canadian Strip Mine Pond ql Certification, October 8, 1997, Page 2 of 3 <br />
