<br />EXIIIBIT B <br />Submitted by Arness-McGriffin Coal Company as part of the <br />Requirements for Coal Mining Permit. <br />Implementation of Section 34-32-116, Duties of Operator. <br />1) Applicant may engage In a mining operation upon the affected <br />lands of the permit, on the performance and subject to the follow- <br />ing requirements: <br />a. Each year, on the anniversary date of Hermit, operator v~t 11 sub- <br />mit a reclamation plan and map shovi ng the affected lands and details, <br />Operator shall submit an annual fee of two hundred seventy-five <br />dollars for the underground operation. <br />• b. Grading will produce leveled terraces which will blend into <br />adjacent hillside slopes. The final land use will be sloping woodland; <br />the only past use has been for timber and possibly sheep grazing. <br />c. There are no plans presently to impound water by dams <br />or other means. <br />d. Toxic materials are not known to exist in the mining area <br />but if encountered to the course of mining, steps w[ll be taken to <br />neutralize the toxic material before it is allowed to enter the natural <br />dra[nage system. <br />e. All refuse and waste products will be hauled to an appropriate <br />dump area. <br />-13- <br />
