` ~ ~. ~ ~ M • <br />Mr. James B. McArdle <br />Mined Land Reclamation <br />May 13, 1982 <br />Page 6 <br />for four consecutive weeks beginning with the publication of April 8, <br />1982. Proof of publication and proof of land owner notification has <br />been submitted to your office. <br />The following comments are in response to the Office of the State Engineer, <br />Division of Water Resources, memorandum dated March 29, 1982, to your office. <br />The applicant is aware of the law as outlined in paragraph 1 of the memo- <br />randum and intends to revise, as necessary within the limits of the law, the well <br />permit application which now is pending for dust control. The Division of Water <br />Resources request for development of a water augmentation plan to support the well <br />permit will be addressed at the time it becomes an issue. <br />The Hayseed Ditch has been addressed earlier in this response. No further <br />discussion is necessary since the Ditch is abandoned. <br />The Last Chance Ditch has been addressed by special letter dated April 8. <br />A copy is on file in your office. The applicant's letter stated his resolution <br />to legitimate concerns that the company might have and requested a meeting if the <br />conditions needed further discussion. No response from the Ditch Company has <br />occurred. As stated in the letter, sealing, monitoring or other measures as may <br />become necessary to avoid damages to Last Chance will be initiated. <br />The applicant has no knowledge of any adjacent ponds or nearby recorded wells <br />within 200 feet of the mining operations. <br />The applicant will meet with representatives of the St. Vrain and Left Hand <br />Ditch Water Conservancy District to mitigate the concerns of the District as they <br />pertain to the gravel mining operation. Accounts of pertinent discussion and/or <br />agreements will be submitted to your office as requested by the Division of Water <br />Resources. <br />We believe that we have covered fully and openly all of the issues that have <br />been raised by all parties in this matter and have attempted to provide documenta- <br />tion and information as necessary to assure the Mined Land Reclamation Board that <br />the Siegrist Construction Company is making every attempt to comply with all appli- <br />cable regulations pertaining to this permit application. We intend to appear at <br />your regular board meeting of May 26-27, 1982 to discuss this application at that <br />time.
