We represent the City of Rifle ("City"). On behalf of the City, we have prepared this
letter in response to your request for public comment on Roaring Fork Resources' Clean Water
Act §§ 401 and 404 permit application. The permit application requests a Department of the
Army permit and water quality certification for the discharge of dredge and fill material into the
Colorado River and 10.73 acres of adjacent wetlands by a proposed gravel thine operation. The
proposed mining operation will be located along the Colorado River, near the entrance to the Ciry
of Rifle. As the mine is located directly above the City of Rifle and the City's water intake
structure, the City has significant concerns about the mine's aesthetic impacts, the mine's impact
on the City's water quality and supply, and the mine's impacts on the geomorphologic stability
