PART I
Page No. 6
Perini[ No. COG-850000
B. EFFLUENT LIl1-IITATIONS AND MONITORING REQUIItEMENTS
1. Effluent Limitations
b. Post-Minin¢ Outfalls (continued)
POST-MINING ALTERNATE LIMITATIONS
Any dischazge or increase in the volume of a dischazge caused by precipitation within any 24-hour period
Qreater than the 10-veaz. 24-hour orecioitation event (or snowmel[ of equivalent volume) may comply with
the following limitations -- subject to burden of proof requirements described in Pan I.B.I.d).
Parameter
Limitation
Flow, MGD Repon
Settleable Solids, mP/P Report
pH, s.u. 6.5-9.0
Oil and Grease, mg/P 10
Total Dissolved Solids, mg/P Report
CO River Basin ONLY
Total Phosphorus (as P), mglP
Dillon Reservoir and C pper Beaz Creek Drainages ONLY Report
c. General Limitations -Active and Post-Mining Outfalls
1) There shall be no dischazge of sanitary wastewaters from toilets or related facilities.
2) There shall be no dischazge of floating solids or visible foam in other than trace amounts.
3) There shall be no land application of wastewater other than for dust control.
4) No chemicals shall be added to the dischazge unless specific approval is granted by the Division
d. Burden of Proof Requirements
The permittce has the burden of proof when requesting relief from total suspended solids (TSS), total iron
and/or settleable solids limitations. Relief shall be granted only when necessary and shall not be granted
when the permittee has control over the dischazge. The perminee should endeavor to meet the primary
limitations whenever possible. The Division shall have final authority in determining whether relief is
granted.
1) For rainfall, [o waive TSS and total iron limitations, it is necessary to demonstrate that dischazge
occurred within 48 hours after measurable precipitation has stopped. To waive settleable solids
limitations, it is necessary to prove that dischazge occurred within 48 hours after precipitation greater
than the (0-yeaz, 24-hour event has stopped.
2) For snowmel[, to waive TSS and total iron limitations, it is necessary to demonstrate [ha[ dischazge
occurred within 48 bolus abet pond inflow has stopped. To waive settleable solids limitations, it is
necessary to prove that dischazge occurred within 48 hours afrer pond inflow volume greater than the
10-yeaz, 24-hour event has slopped.
The Division shall determine the adequary of proof. As part of this determination, the Division shall
evaluate whether the pertni[[ee could have controlled the dischazge in such a manner that primary limitations
could have been met. All manual dewatering of ponds that are equipped with automatic dewatering systems
must meet TSS and total iron limitations. If a pond has only tnanual dewatering capability, relief is
available only to the extent required to regain necessary stability and capacity.
See Part I.C. for Definitions
