This hauling road brings <br />heavy equipment in closer proximity to Mrs. Terry than it <br />has been in past ogerations. It has been Mrs. Terry's <br />exerience that promises to wet down the hauling road are <br />not kept or are not adequate. The applicant proposes to <br />operate a rock crusher in the processing site area which <br />creates further noise, dirt and pollution. It has been <br />Mrs. Terry's experience from prior operations of Corn Con- <br />struction Company conducted nearby that not only the mine <br />operations continue 24 hours a day but also the rock crusher <br />and pumps operate 24 hours a day. This creates a tremendous <br />noise and general discomfort to Mrs. Terry and her family. <br />Although it is not a <br />Construction Company <br />permit to operate an <br />rock crusher. This is especially appropriate <br />in that the habitat of at least four endangered species <br />will be disturbed not only by the destruction of the ground <br />but the general dust, noise and commotion caused by the <br />operation. In particular, it should be pointed out that the <br />Wildlife Division finds that rectangular pits (see Exhibit "H") <br />are unacceptable. Review of the shape of Pit No. 1, as is <br />described in Exhibits "C" to "~", indicates the type of pit <br />which is unacceptable to the Division of Wildlife. <br />The most obvious concern of Mrs. Terry is that the operation is <br />going to take place within two hundred yards of her residence. <br />Of course, the various needs and desires of the parties have <br />to be considered, however, the effect of allowing a gravel <br />operation within such close proximity to her residence is to <br />destroy tdrs. Terry's rights of peace and quiet enjoyment of <br />her property by the creation of an unnecessary and unwanted <br />
