Speci- fically, at no time s}~all t}ie extractive operations go bey nd the actual sand bar area located within the boundaries of the affected mi ing area as stated on tkie land use application, consisting of about 1.0 0 1.5 acres. The operations shall consist of only one meditun-sized front- nd loader and, at any given time, only one medium-sized dump tn:ck, of ten to twelve yards of hauling capacity, shall be loaded on tl~e site. There s to be no stock- piling, c n:s},ing, or processing of any materials at t}~e s to nor any storage of equipment, machinery, or vehicles, except for tiie fron -end loader during actual mining operations, at the site. All equipment a vehicles located and operated on tl.e site s}~all have fully operation muffler devices attac}~ed at all times during operation. T}~e hours of peration shall be confined to daylight, and in no case earlier than 7:30 a m. nor later than 6:30 p.m., Monday t}~roug}~ Saturday. There is to be no c shing or material processing operations conducted on the site at any time All l.auling and equipment movement is to be confined to t.}ae mine area and }:e }caul road to U. S. Hwy. 550. The haul road to U. S. Hwy. 550 shall be raveled and dust- retardant applied, as necessary, to control fugitive dust T}~e operator is to use appropriate techniques and materials to control any fugitive dust which may be generated by the operation so as to prey nt any detectable levels of particulates from leaving the site. There are t be no operations on tkie site during periods of high water or during perio s when the Animas River is at flood stage. Any equipment or machinery pr sent on t1,e site shall be promptly removed during periods of high water or when flood danger is present. T}~ere shall not be any encroac},ments, fil s, structures, or substantial improvements located wit}iin the floodway of th Animas River. 4. Periodic Review and Enforcement: This land use approval is expressly contingent upon and subject to the operator' receipt of and compliance with all regtired state permits or approvals, ncluding, but not limited to, the permit for the proposed operation required from the Colorado Mined Land Reclamation Board. Should t},e Colorado Mined Land Reclamation Board or any other state agency, whose permit or approval i required for t}~e Sandpit operation, suspend or revoke such permit or appro al for the opera- tion, the County's land use approval shall be deemed suspen ed or revoked, as appropriate. T}ie operation of the Sandpit shall be reviews by this Board on a biannual basis to determine if t}ie operation is in co pliance with tl~e terms and conditions of County land use approval set fort ~ in tkiis Resolu- tion. Such biannual review shall be },eld within the nine (90) day period preceding such anniversary date. Any written allegations at the Sandpit is operating in violation of the terms and conditions of pproval shall be referred to t}ie County planning staff for investigation. T}~e County staff shall promptly investigate any such written allegations con erning violations and report their findings to this Board,
